Litigation Practice

As experienced litigators, we are sensitive to the needs and desires of our clients. We know that litigation is not only expensive but often unpredictable. Our objective is to achieve client goals in the most effective manner possible. The firm develops general strategies for litigation avoidance, reviewing clients' contracts and procedures with the goal of maximizing their legal position so that disputes may be resolved from a position of strength; however, certain situations require immediate aggressive action, such as obtaining injunctive relief, expedited discovery and otherwise moving a case rapidly through the system. Sometimes a client's interests are better served by alternate dispute resolution procedures, such as negotiation or mediation. These and other alternatives are considered and revisited throughout the litigation process. The client makes the ultimate decision in collaboration with the attorney.

Our attorneys are admitted to practice in the state of New York, to the Federal District Courts for the Southern and Eastern Districts of New York as well as other District Courts in states where we have been admitted for the purpose of particular cases, the United States Circuit Court of Appeals for the Second Circuit, and to the United States Supreme Court.

Although we are probably best known for our work in the medical malpractice areas, we are fully experienced in real estate litigation, contract litigation, corporate litigation, including "squeeze out" and related shareholder oppression, and employment-related litigation. A number of our decisions have been judged of sufficient importance to be featured in legal publications, such as the New York Law Journal and The American Lawyer.

Consistent with the modern trend of alternate dispute resolution, such as mediation and arbitration occurring outside the court system, we have been selected to the Panel of Arbitrators of the American Arbitration Association, and serve as arbitrators judging and adjudicating claims in arbitration. This brings invaluable experience in evaluating cases and trial techniques from the standpoint of a judge, and we apply these skills when representing our clients. We regularly arbitrate before the various domestic arbitration tribunals in the United States and before the International Chamber of Commerce in Paris in international disputes, and mediate both within the context of court cases and before independent alternate dispute resolution agencies, such as JAMS and the American Arbitration Association.
